TERMS & CONDITIONS​

1. General & Agency Status

1.1. Scope of Agreement: These Terms and Conditions ("T&C") govern all product offers, orders, and sales facilitated by Cascata Fine Wines and Spirits Inc. (the "Agent" or "Cascata FWS") to clients in the Province of Ontario. By placing an order or using this website, you agree to be bound by these T&C. 

1.2. Agency Role:
Cascata Fine Wines and Spirits Inc. is a licensed Ontario agent (Agent) under the Alcohol and Gaming Commission of Ontario (AGCO), representing international wine and spirits suppliers and producers in the Ontario Market. 

1.3. Regulated Sales:
All sales of beverage alcohol are processed and fulfilled exclusively through the Liquor Control Board of Ontario (LCBO), as required by Ontario law. Cascata FWS acts solely as your facilitator and agent in arranging these purchases. Cascata FWS does not sell or mark up beverage alcohol; we only facilitate an arrangement whereby the client purchases directly from the LCBO. 

1.4. Legal Drinking Age: By accessing this website and, or; placing an order, you confirm that you are at least nineteen (19) years of age, being the legal drinking age in the Province of Ontario.

2. Orders, Pricing, and Payment

2.1. Order Requests:
Any submission of an order through Cascata FWS constitutes an offer to purchase product through the LCBO’s Consignment Program or any other LCBO available channel, as facilitated by the Agent.

2.2. Contract Formation: An order is deemed accepted and becomes a binding contract only when the Agent issues a formal order confirmation and invoice, and/or the LCBO confirms the processing of the order request.

2.3. Pricing:

All prices quoted are in Canadian Dollars (CAD) unless otherwise specified, and are estimates based on current LCBO policies, duties, taxes, and exchange rates. The final purchase price is subject to final approval by the LCBO and may change without notice prior to the order being locked in with the supplier. Prices include all LCBO taxes and mark ups, as well as our agency service fee, but excludes the HST and bottle deposit. LCBO sale price is reflected in our invoices.

2.4. Product Availability: All offers are subject to final confirmation of allocation and availability from the supplier and approval by the LCBO.

​3. Delivery, Title, and Risk

3.1. Title Transfer: Legal title to the alcoholic beverage products transfers to you only upon successful delivery or pick-up at an LCBO-designated facility (e.g., LCBO store, Vintages location, or licensed warehouse) and completion of the LCBO's final transaction process.

3.2. Delivery/Pick-up: 

•    Delivery Locations & Fees: Cascata FWS provides complimentary delivery service within the Greater Toronto Area (GTA) on scheduled delivery days. For locations outside of the GTA, orders will be handled by a qualified third-party courier service, with the delivery fee and cost being the responsibility of the client. Products may be delivered to or picked up from an LCBO-managed facility as determined during the ordering process

•    Scheduling and Timelines: Deliveries are conducted Monday through Friday. While most orders can be arranged within 2-7 business days of release from the LCBO system, remote locations handled by a third-party courier may take longer. A representative from Cascata FWS will contact you to schedule and confirm your delivery date shortly after your order is ready for dispatch.

•    Receipt of Order & Compliance: Someone of legal drinking age (19+ in Ontario) who is not or does not appear to be intoxicated must be present to receive the order. We are legally unable to leave beverage alcohol with anyone under the legal drinking age.

•    Delivery Logistics: It is your responsibility to be present at the delivery address on the scheduled date to receive your order. Orders cannot be delivered to a P.O. Box. Each individual order can only be delivered to a single, confirmed delivery location. For multiple delivery addresses, separate orders must be placed.

3.3. Risk: Risk of loss and damage passes to the client upon the client taking physical possession of the product at the designated pick-up or delivery point.

4. Returns and Cancellations

4.1. General Returns and Quality Issues:

•    All product returns are primarily subject to and must comply with the Liquor Control Board of Ontario (LCBO) Product Return Policy. 

•    Should you need to return an item or report a quality issue (e.g., corked or faulty wine), please contact the Agent immediately by email at santiago@cascatafws.com with your order number and the nature of the issue.

•    If the item(s) is in its original condition and is returned in accordance with LCBO procedures, the purchase price will be refunded. If the product was shipped outside the GTA, the initial or return shipping charges are the responsibility of the purchaser.

•    Faulty items (e.g., product defects or condition concerns) will be evaluated on an individual, case-by-case basis by the Agent and the supplying producer before a final decision on replacement or refund is made.

4.2. Returns of Older Vintages:

•    You acknowledge that there is inherent risk in buying older, fine, or rare wines. While Cascata FWS ensures all products are stored properly prior to dispatch, the nature of older wines means the contents may nevertheless be defective or past optimal consumption due to age.

•    We regret that we cannot accept for return wines more than seven (7) years old and costing in excess of $100 CAD unless the producer explicitly agrees to replace or refund the wine.

4.3. Cancellations and Fees:

•    Cancellation of confirmed orders may be permitted only if the product has not yet been processed or imported by the LCBO.

•    A restocking fee may apply to cover costs incurred by the Agent for administration, logistics, or supplier commitments if a confirmed order is cancelled after processing has begun.

5. Governing Law and Dispute Resolution

5.1. Governing Law:

These T&C and all transactions facilitated by Cascata FWS shall be governed by and construed in accordance with the laws of the Province of Ontario and the applicable laws of Canada.

5.2. Jurisdiction: You irrevocably attorn to the exclusive jurisdiction of the courts of the Province of Ontario with respect to any dispute arising under these T&C.

6. Privacy

6.1. Privacy Policy: Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these T&C by reference. You consent to the collection and use of your personal information as set out in that policy.
